1 Acceptance of Terms

These Terms & Conditions ("Terms") govern your access to and use of Songlr's website, services and applications (collectively the "Service"). By creating an account or using the Service you confirm that you are at least 13 years old and agree to these Terms. If you are under 18, you must have parental or guardian consent.

2 Description of Service

Songlr is a free music streaming platform that lets users discover and listen to music via the YouTube IFrame API, create and share playlists, follow artists and other users, and participate in the Songlr community. The Service is provided free of charge and is supported by us at no cost to you, as-is.

3 YouTube API Services

Our Service uses the YouTube IFrame API. By using Songlr, you agree to be bound by the YouTube Terms of Service.

All audio content is streamed directly from YouTube's servers. Songlr does not host, store or redistribute copyrighted audio files. We operate under the embedding model explicitly permitted by YouTube's API Terms. Rights holders who wish to remove specific content from YouTube should contact YouTube directly through their copyright removal process.

4 User Accounts

To access certain features you must create an account. You agree to: provide accurate registration information; keep your password confidential; notify us immediately if you suspect unauthorised access to your account; take responsibility for all activity under your account.

We reserve the right to terminate or suspend accounts that violate these Terms, at our sole discretion, without notice.

5 Acceptable Use

You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorised access to our systems or other users' accounts; (c) upload, post or transmit harmful, offensive, defamatory, or sexually explicit content; (d) impersonate any person or entity; (e) use automated tools (bots, scrapers) to access the Service without our written consent; (f) reproduce, duplicate, copy or sell any portion of the Service; (g) interfere with or disrupt the integrity or performance of the Service.

6 User-Generated Content

By submitting content (playlists, comments, profile information, etc.) you grant Songlr a worldwide, non-exclusive, royalty-free licence to use, display, reproduce and distribute that content within the Service. You represent that you own or have the necessary rights to submit such content and that it does not infringe any third-party rights.

We reserve the right to remove any user-generated content that violates these Terms or that we deem inappropriate, at our sole discretion.

7 Intellectual Property

The Songlr name, logo, website design and original code are owned by Songlr and are protected by applicable intellectual property laws. Music metadata, artist names, album artwork and song information belong to their respective owners. Songlr does not claim ownership over any musical works streamed via the YouTube API.

8 Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully.

9 DMCA & Copyright

We respect intellectual property rights. If you believe your copyrighted work has been used on Songlr in a way that constitutes infringement, please contact us at dmca@songlr.com with: (1) your contact information; (2) a description of the copyrighted work; (3) the URL of the allegedly infringing content; (4) a statement that you have a good-faith belief the use is not authorised; (5) your signature.

Note: because all audio is streamed via YouTube, the appropriate party for audio takedowns is YouTube. We will promptly remove any associated pages upon receiving a valid notice for our platform-specific content.

10 Disclaimers & Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee uninterrupted availability or that the Service will be free of errors.

To the maximum extent permitted by law, Songlr shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

11 Third-Party Links

The Service may contain links to third-party websites. These are provided for convenience only. We have no control over third-party content and accept no responsibility for it.

12 Termination

We may terminate or suspend your account and access to the Service at any time, for any reason, with or without notice. You may delete your account at any time through the Settings page. Upon termination, your right to use the Service ceases immediately.

13 Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through good-faith negotiation, and failing that, through binding arbitration or a court of competent jurisdiction in the jurisdiction where Songlr operates.

14 Changes to Terms

We reserve the right to modify these Terms at any time. We will notify registered users of significant changes by email or by posting a notice on the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.
